1. Scope

These General Terms and Conditions apply to all interpreting and/or translation assignments received by Sprachschule & Übersetzungsdienst Weiss.

 

2. Scope of the Translation or Interpreting Assignment

By placing a translation or interpreting assignment, Sprachschule & Übersetzungsdienst Weiss, guarantees to carry out the assignment conscientiously and to deliver the translated text or interpreting service complete, without omissions or additions, and punctually. No further obligations shall be assumed.

 

3. Client’s Duty to Cooperate and Provide Information

The client must inform the person performing the assignment in good time about the required form of delivery.

Interpreting: Additional services (e.g. audio or video recording) will incur extra charges.

Translation: The client determines the format (electronic, e.g. USB stick or email; or physical, e.g. by post or hand-delivery), layout, intended use, number of copies, etc. All documents necessary for the assignment (illustrations, drawings, tables, abbreviations, etc.) must be provided unprompted and in good time. The service provider shall not be held financially accountable for any errors or delays resulting from failure to comply with these terms or failure to submit relevant documents. The client assumes liability for the content of the text and for reproduction rights, and ensures that the translation may lawfully be made.

 

4. Client’s Rights in Case of Defects

Translation: The client may request correction of any defects, specifying them in detail. The service provider reserves the right to remedy defects. No additional charges apply for reasonable revision work.

 

5. Liability

Liability of the service provider is limited to cases of gross negligence or intent.

Interpreting: Liability is capped at the amount of the agreed fee. Liability for consequential damages is excluded.

Translation: Disruptions caused by e-mail transmission errors, viruses, or computer failures do not constitute gross negligence. Liability for slight negligence applies only if essential contractual obligations have been breached.

 

6. Professional Secrecy
The service provider undertakes to maintain strict confidentiality regarding the assignment. Information and data are to be treated as strictly confidential and must not be used for personal gain.

 

7. Involvement of Third Parties

Translation: If necessary, the service provider may engage qualified third parties. Such third parties are likewise bound to confidentiality as set out in Section 6. This remains the service provider’s responsibility.

 

8. Fees

Interpreting: The agreed fee becomes due upon completion of the assignment. A minimum of one hour is charged per assignment, rounded to the nearest quarter hour. Booked but unused time will be invoiced.

Translation: The agreed fee becomes due upon completion of the assignment. By written agreement, partial or advance payments may be required by the service provider before delivery. If the client withdraws during execution, the agreed fee for work performed will be invoiced.

 

9. Subsequent Changes and Additional Work

Translation: If the client requests non-minor changes after delivery, the deadline may be extended and additional work charged.

 

10. Retention of Title and Copyright

Translation: The client obtains usage rights only upon full payment; until then, the translation remains the property of the service provider. Any resulting copyrights remain with the service provider.

 

11. Cancellation

Interpreting: If an assignment is cancelled or the appointment is changed at short notice, the agreed fee and any demonstrable costs will be invoiced. Cancellations or changes must be notified in writing at least 48 hours before the appointment during business hours. In this way no additional costs incur.

 

12. Amendments
Changes to fees, these GTC, etc., are reserved by management at any time. The published conditions apply.

 

13. Applicable Law
Swiss law applies. Jurisdiction is Aarau.
